France: La Poste loses appeal against conviction for breach of vigilance requirements

The Paris Court of Appeal has upheld La Poste's conviction for breaching its duty of vigilance under French law. This is the first decision by the specialised chamber for sustainability disputes, which clarifies the interpretation of the law's application, particularly in consultation with trade unions.

In a decision handed down on 17 June, the Paris Court of Appeal upheld the first instance judgment of 5 December 2023, condemning La Poste for violating its duty of vigilance. This followed proceedings brought by the Sud-PTT trade union federation, which accused the group of failing to exercise its due diligence requirements to protect subcontractors sufficiently in terms of health and safety. The French group, which employs 232,000 people, was ordered to clarify its risk mapping, monitor the implementation of preventive measures based on these risks, and set up a mechanism for alerting and collecting reports.…
