Belgium: a Royal Decree is published authorizing night work in the e-commerce sector

The Royal Decree, published on 10 March, authorizing night time work in the e-commerce sector appeared in the Belgian Official Journal on 18 March. As part of its digital program, e-commerce is one of the coalition government’s topics for focus and how banning night work was holding back jobs growth in this activity. The move to liberalize is what prompted unions to conclude agreements at the end of 2015 that frame recourse to night work.

Under one condition, night work is now authorized for companies belonging to the following four joint commissions*: CP 201 – independent retailers, CP 202 – employees in retail food distribution, CP 311– large wholesalers companies, and CP 312 – large shops. The condition is that the nature of the work or activity must be justified by recourse to night work, and employers must show this to be the case.
