On 25 February Ontario’s independent, quasi-judicial tribunal mandated to mediate and adjudicate private sector employment and labour relations-related matters ruled that couriers are dependent contractors (a legal term for independent workers that are economically dependent on a contractor) and as such have the legal right to unionize.
The Canadian Union of Postal Workers (CUPW) had sought trade union certification with the OLRB for the Foodora couriers working in Toronto and Mississauga. The union certification vote was held but the results were sealed following a challenge by the food delivery platform that argued against the workers’ right to unionize since it considered them to be independent contractors.
