In an opinion delivered on 14 January, the Advocate General of the Court of Justice of the European Union (CJEU) has supported Denmark's request for the annulment of the directive on minimum wages. He considers that the directive violates the Treaty on the Functioning of the EU, pointing out that the Treaty allows the EU to adopt directives to establish minimum requirements for working conditions, but not to legislate on workers' pay.
On 14 January Nicholas Emiliou, Advocate General of the Court of Justice of the European Union, delivered his opinion on Denmark’s application of 18 January 2023 for the annulment of the directive on adequate minimum wages. He agrees with Copenhagen’s arguments and considers that the directive should be annulled on the grounds of its “incompatibility” with the Treaty on the Functioning of the EU (TFEU Article 153(5)).
