The talks between the Council of Ministers, the European Parliament and the European Commission on the Posted Workers Directive (96/71/EC) finally led, on Thursday, February 27, to a preliminary agreement. The Parliament secured the amendment of Article 9 on national control measures and administrative requirements. Article 12 on the legal responsibility of subcontracting should remain the same as in the political agreement reached by the Council of Ministers in December 2013 (see article No. 130785). The Council and Parliament still need to validate the text before it can become permanent.
Article 9: the list of control measures. The first challenge was to agree on national control measures and administrative requirements to combat avoidance of existing rules on working conditions to which posted workers are entitled by virtue of Directive 96/71 (Art. 9).
