EU: Court starts applying the protection of employees in the event of transfer of undertaking to a triangular employment relationship

An employee of Heineken international (HNB), posted to Heineken Nederland BV, was in charge of bringing meals to Heineken’s employees on different sites.  This activity was then sold to the Albron company.  Given their special status, the employee in question and his colleagues in the same situation weren’t given the protection granted for corporate transfers and were employed under less advantageous terms.  The prejudicial question asked to the Court comes from the action brought to enforce the transfer protection system.
