The revision to the EU rules on the posting of workers has clearly upset some of the EU Member States. After the Monti 11 2012 regulation (that limited the cross-border right to strike) met with the ‘yellow card’ procedure it is now the turn of the new directive on the posting of workers to have to come against the ‘yellow card’. Ten Member States had submitted a reasoned opinion to the European commission criticizing the text for being in conflict with the right to subsidiarity. An eleventh State may also submit a similar negative opinion before the deadline of midnight 10 May.
