The Parliament’s Commission for social affairs proceeded to its last hearing, last 20 April, on the application of the directive on workers’ posting. The cases pending before the CJEC which trigger a contradiction between labor laws and freedom to provide services are orienting the debate towards a new direction. The initial question relating to the application of national standards to posted workers has raised new ones : the future of the Scandinavian social dialog model, and the future of unions‘ right to collective action. Both of them have been affected by the free delivery of services. (Ref. 06411)
It was not by pure coincidence that an expert on Scandinavian social dialog was heard during this last audition: the cases pending before the CJEC which illustrate the best the permanent conflict between social rights and free delivery of services involve Sweden and Finland. Professor Nikklas Bruun, of the Arbeitslivstintitutet, was in charge of explaining the specificities of the Scandinavian model to European deputies.
