Identified loopholes. Article L. 1233-4 of the Labor Code provides that “the economic layoff of an employee can only accepted when all training and adjustment efforts have been made and when the employee cannot be redeployed in the company or in the undertakings of the group he belongs to. The employee shall be redeployed to a job belonging to the same category as his current job or a similar job. Where appropriate, and with the employee’s express consent, the employee may be redeployed to a lower category.”
