On April 6, 2006, the revised Transfer of Undertakings-Protection of Employment regulations (TUPE) are due to come in effect. However, the government has not yet submitted a bill to Parliament. The aim of the new law is to transpose the new Business Transfers Directive. This Directive was passed in 1977 and significantly updated in 1998. (Ref. 06109)
This time, the British government is 8 years late. The BusinessTransfers Directive, also known as Acquired Rights Directive, was updated in1998. In 2006, the Blair administration has still not changed the TUPE regulations. It had planned on passing this law before October 1st, 2005. The previous law,of 1981, was meant to transpose the first version of the Directive, passed in1977. A that time, the government had “only” taken four years to comply withEEC rules.
