On September 12, the Council of Ministers adopted a bill aimed at ensuring compliance of the Labor Code with European regulations on posted workers as interpreted by the Court of Justice of the European Communities. The bill removes some disputed elements regarding the notion of social law and order and revises the administrative obligations to which the companies which post personnel in Luxembourg are subject. In a décision of June 19, 2008, the CJEC condemned Luxembourg for failure to transpose directive 96/71 on the posting of workers as part of a provision of services. The government reacted quickly with the adoption of a bill aimed at redressing this failure to comply with Community law.
