A special group of magistrates is working on the revision of the "judges' method", which determine the amount of the benefits granted by the court to dismissed employees, revealed on February 26, 2008, the economic daily Het Financieele Dagblad. This group of magistrates was created before the November 2006 legislative elections and before the debate which followed the relaxation of the law on dismissals. (Ref. 080166)
The current system is based on one month’s salary per seniority year. This level goes up to a month and a half for people over 40, and two months for people over 50. The benefits can be increased or lowered, depending on the possible faults made by the employer or the employee. At the moment, magistrates are questioning this method for people over 50 who worked for a short period before being dismissed.
