Portugal: new criteria to choose which employee to dismiss when a job is cut

The government is preparing a list of criteria to choose the person who will be fired in case of individual layoffs when a position is removed.  This form of layoff was made more flexible in the 2012 Labor Code but the Constitutional Court invalidated the reform.  Unions were not consulted before hand and view this as “provocation.”  (Ref.  130804)

List of criteria to choose which worker will be laid off when a job disappears. Until 2012, the Labor Code provided that, in case of a layoff for termination of the position, the most recent worker in the company and job in the position in question would be fired. The new Code allowed businesses to apply these criteria as long as they are not discriminatory – without any details.
