On January 21, the Chamber of Deputies adopted the draft revision of the Labor Code. This review of a text adopted on November 7, 2008 follows the decision of the Constitutional Court (see our dispatch No. 090011) on the invalidity of the article which brought from 90 to 180 days the try-out period for unskilled workers. This article was the only one removed, in spite of unions and left wing parties' attempts to amend other provisions. (Ref. 090079)
Reducing the try-out period. The new version of the Portuguese Labor Code overrides the previous version which planned to bring try-outs from 90 to 180 days. Going from 3 to 6 months of try-out was only supposed to apply to low-skilled or unskilled workers because the Code in force already provides that the try-out can be brought up to 180 days for technologists and to 240 days for high posts.
