To avoid another reasoned opinion from the Court of Justice of the European Union for incomplete transposition of Directive 2002/71 on the principle of equal treatment for men and women as regards access to employment and working conditions, Slovakia adopted, on February 8, 2011, the bill we presented in October 2010 (see our dispatch No. 100718). The new law limits the extent of the required protection of women to pregnant women and mothers up to nine months after giving birth, and breastfeeding women. However, one of the most important changes to the Labor Code is the provision on an employer’s obligation to reinstate employees returning to their posts after maternity leave under conditions which are not less favourable than the conditions they worked under when they took the leave. These employees are also entitled to benefit from any improvement in working conditions to which they would have been entitled during their absence.
