Spain: the social partners are making progress in the debate for the collective bargaining reform

Internal flexibility.  Employers and unions agree on the goal and want to secure internal flexibility as the necessary answer to guarantee the viability of businesses.  The whole problem is to find how to determine systems within the collective agreements that allow unions to have a say when employees’ working conditions are amended to face a negative economic situation.  Thus, the management’s decision-making process will have to be combined with the participation of the staff representatives, following information, consultation and negotiation depending on the seriousness of the decision to make.  Employers and unions are looking at a way to add to collective agreements the ways to help businesses react to new situation.  The measures envisioned are pay disengagement, amending working conditions, functional and geographical mobility, suspending the labor contract for economic, technical, organizational, productive reasons or cases of force majeure, working time changes, and training.
