Judges gave satisfaction to the trade unions in two similar rulings which concerned Carrefour for one and Makro for the other. The two rulings force these companies to respect their employees' right to 48 hours of weekly rest in a row. Indeed, the Court considers that the 12-hour daily rest which must divide two work days can by no means overlay the 36 legal hours of weekly rest. (Ref. 080969)
Makro and Carrefour now have to follow these rulings, which confirm another sentence for similar reasons with Leroy Merlin in 2005 (see our dispatch No. 061079).
Carrefour. The sentence delivered on September 28, 2008 confirms a ruling by the Audiencia National on May 8, 2007 (see our dispatch No. 070478), which the company refused to apply. Carrefour’s 11.000 workers in Spain could now get 24 additional resting days per annum according to the assessments made by Juan Sanchez, UGT representative
