Sweden: controversial draft bill on the protection of private life

Ban on gathering some personal information. The current law provides that employers may have access to the criminal records of applicants under certain circumstances. They can also get information on credits or debts because such data is public. Also, the work group acknowledged that it was necessary to find balance between the legitimate need to prevent some risks related to some jobs and the protection of private life. It developed proposals: the ban for employers to ask an employee or an applicant, in cases not provided for by law, for their criminal records; a similar ban on extracts of the register of infractions (misstankeregistret); the ban on asking applicants or employees social security details, notably on sick leaves or leaves to care for sick children.
