The Court of Justice of the European Communities (CJEC) has rejected the European Commission's appeal, which estimated that Sweden had not correctly transposed article 7 of directive 89/391 of June 12, 1989 on the improvement of safety and health at work. (Ref. 06613)
Article 7 of the directive provides that “the employer appoints one or more workers to occupy the protection activities and the prevention activities of professional risks at the company and/or the establishment”. These workers “must be able to do it and have the necessary means: for example they need to be “in a sufficient number”, to deal with the activities of protection and prevention.
