The Court of Justice of the European Union (CJEU) ruled on 3 June that employees of the UK supermarket chain Tesco could rely on an article of EU law to claim equal pay. The ruling comes after a group of around 6,000 employees brought a complaint – about the inferior pay for staff working in stores (mostly women) compared to those employed in warehouses (mostly men) – to the Watford Employment Tribunal, which sought the advice of the Luxembourg-based institution, requesting a preliminary ruling.
The Court of Justice of the European Union, which had the authority to rule on the matter as the request for a preliminary ruling came before the end of the Brexit transition period, first considered the interpretation of Article 157 of the Treaty on the Functioning of the European Union, under which male and female workers doing equal work should receive equal pay.
