Belgium: returning medical exam after sick leave extended to all employees

A Royal Decree of January 27, 2008, published in the Belgian Official Journal on March 3, 2008, allows all employees to get a "pre-return" medical exam. The occupational physician can then talk with the employee about their health status and examine the possibilities to adapt their work station. (Ref. 080185)

The Royal Decree of January 27, 2008 makes it possible for every worker to get a pre-return to work medical exam, through an adjustment of articles 5, §3 and 36A §§1 and 2 of the Royal Decree of May 28, 2003 concerning workers’ health status. Beforehand, this was only possible for workers who required special care. The pre-return to work exam enables the prevention advisor and the occupational physician, for an employee who cannot work for at least four weeks, to talk about their health status
