Belgium: total remodelling of the legislation concerning protection against violence and moral or sexual harassment at work

A law passed on January 10, 2007, published in the Moniteur Belge on June 6, 2007, is completely remodelling the legislation in force concerning protection against violence and sexual or moral harassment at work. It is completed by a royal decree concerning "the prevention of the psychosocial charge" caused by these phenomena. These texts are deeply going to alter the dispositions in effect in terms of fight against violence and harassment at work. (Ref. 070504)

First of all, the January 10, 2007 law (art. 4) offers new definitions of violence at work as well as of moral and sexual harassment (in comparison with the definitions of the July 11, 2002 royal decree concerning protection against violence and moral or sexual harassment at work, see link below).

The definitions are extended and strengthened. Violence is defined as a situation where an employee or a related person “is threatened or morally or physically assaulted when performing his/her job.” T
