The Council of Ministers approved, on March 7, 2008, a draft royal decree which clarifies under which conditions workers from a foreign State employed by a company established in the European Economic Area (EEA) can be exempt from a work permit when posted in Belgium as part of a service providing. The draft royal decree cancels the condition under which the worker has to be employed in the company for six months before being posted in Belgium for a service delivery. In addition, the residence permit will have to be valid until the end of the delivery, and not until the end of the delivery plus three months, which the current legislation requires.
