The Ministry of Labor and Social Affairs is preparing a new amendment to the Labor Code to implement the decision of the Constitutional Court of March of this year which repealed several Labor Code provisions (see our dispatch No. 080250). The changes introduced will also aim at liberalizing the labor market, cutting unions' prerogatives in the company and making the employer-employee relations more flexible. (Ref. 080700)
The working group created by the Ministry to draft the amendment has recently established the primary objectives of the reform. The major proposed changes are as follows:
- The trial period should be extended to 3 months for non-management staff and 6 months for management.
- Introduce a more generic definition of causes for an employee’s dismissal and introduce dismissal without a fair cause accompanied by higher severance pay. Besides, employees will have a chance to terminate the contract immed
