This sixth report on the application of regulation n° 3820/85 measures the effectiveness of its implementation by member states in respect of maximum driving times, the minimum pauses for rest and meals applicable to professional drivers as well as control procedures. According to this legislation, modified since by regulation n° 561/2006 and directive n° 2006/22 of March 15, 2006 ( article n° 06352), member states are responsible for checking that at least 1% of the total number of days worked by professional lorry and bus drivers are effectively controlled, that is, either in the framework of on-the-spot inspections in transport companies or through road inspections. For the period 2004-2005, analysis of the data shows that all states, except for Sweden and Portugal, go beyond the uniform inspection threshold of 1% of days worked by professional drivers. Germany, Spain, France, Luxembourg and Malta go beyond 2%.
