In his conclusions delivered on March 12, 2008, the Advocate General Poiares Maduro proposes that the Court accepts that, when an employer tells the media that "he would not recruit persons of Moroccan origin" represents direct discrimination on the grounds of ethnic origin. (Ref. 080209)
During a recruitment campaign, a Belgian employer told the media several times that he would not recruit Moroccans. The Center for equal opportunities and opposition to racism (CGKR – the Belgian organization in charge of fighting discrimination) referred the matter to the Court of Justice, asking:
