EU: national legislation may authorize an employer to order a part-time worker to return to full-time work

On October 15, the CJEU delivered a judgment in which it declares national legislation that allows an employer to order the conversion of working time from part-time to full-time without the workers’ consent is consistent with Community law.

The dispute arose from the refusal by an employee of the Italian Minister for Justice to take up full-time employment. The employer demand was in line with legislation that allows re-examination of decisions that allow part-time work. The employee asked that the decision to convert to full-time be reversed due to the fact that Directive 97/81 which protects part-time workers, established a principle by virtue of which the worker cannot have his work time converted to full-time against his/her w
