EU: release of the new directive on the posting of workers in the framework of the provision of services

The directive on the enforcement of Directive 96/71 concerning the posting of workers in the framework of the provision of services was published in the Official Journal on May 28.  Adopted before the European elections to show that the EU is addressing social dumping, this directive contains a series of provisions, control measures and mechanisms that aim to improve and harmonize enforcement of Directive 96/71, deemed incomplete.

This directive enforcing Directive 96/71 aims to improve cooperation and exchange of information between monitoring bodies and also contains provisions to clarify information/document requests and formalities that can be requested from providers coming from another EU Member State in order to facilitate controls and make sure the host country’s core social rules are respected.
