EU: the European Commission questions the pertinence of imposing the obligation to inform of essential aspects in employment contracts for certain new forms of employment

On 27 January, the European Commission launched a public consultation on the employer’s obligation to inform workers of conditions that apply in the employment contract, or as regards the employment relationship, as intended by Directive 91/533. The consultation is in the form of a public questionnaire, which should enable an assessment of the efficacy of this Directive as well as the possibility of adapting it to the current development of new forms of work.

This consultation sits at the crossroads between the European Commission’s REFIT program to ‘better legislate’ which consists of reviewing European laws in order to verify their efficacy vis-à-vis the goals they initially try to achieve and the Commission’s Social Rights Pillar which will also treat the question of adapting social legislation to new work life circumstances (c.f. article No. 9477).
