After the law of August 2, 2005 reforming the status of posted workers in France, two decrees passed on November 21, 2006 (especially for airlines, see our dispatch No. 061245) and on December 11, 2007 (see our dispatch No. 071026), the labor administration published a circular which details the system for transnational posting. Circular 2008/17 published by the labor relations department (DGT) which repeals circular 94/18 of December 30, 1994, was awaited. It sets, regarding labor law only, obligations imposed on foreign companies which post workers in France. On the contrary, the circular doesn’t apply to the system of labor permits and the social security rights of the posted workers, which are managed elsewhere.
