Whereas the regulatory part of the new Labor Code will soon be published, the whole new Code will come into effect on May 1, 2008. As for the legislative part, it was determined by Ordinance No. 2007-329 of March 12, 2007. It was ratified by the law No. 2008-67 of January 21, 2008, and validated on January 17, 2008 by the Constitutional Council (ruling No. 2007-328 DC). (Ref. 080195)
The new Code is the result of a governmental job which respected the objectives determined by the legislator: adapt the Labor Code’s legislative provisions on the basis of established law to include those which haven’t been codified, to improve its project and to repair, if necessary, codification mistakes or deficiencies (Law No. 2006-1770, December 30, 2006).
