British justice has just referred to the CJEC the case opposing the Heyday organization to the British government, regarding the « default retirement age » at 65 years old. On December 6th, British justice decided to refer to the Court of Justice of the European Communities (CJEC) Heyday’s appeal against one measure of the law against discriminations on grounds of age ,which allows employers to force an employee over 65 to retire. The law, which took effect on last October 1st (see story n° 061132) protects employees up to 65 only. After 65, the employer is free to keep the senior worker or not.
