Great Britain: Sentencing Guidelines Council tightens the screws on businesses guilty of corporate manslaughter

Details of the guidelines. The fines imposed on businesses found guilty of corporate manslaughter will be in the order of several million pounds – rarely below ₤500,000 (€573,500). Regarding health and safety offenses causing death, fines will range between ₤100,000 (€114,680) to several thousand pounds. The company’s financial situation will have to be taken into consideration in determining the fine. However, the court doesn’t have to consider the impact of the sentence on shareholders and managers but may consider its effect on “the employment of the innocent” and the quality of public services. The obligation for the company to publish its culpability and the details of the offense and of the fine will also be included in the sentences. Besides, aggravating factors will include: the foreseeable character of the serious injury; the frequency of health and safety offenses in the company; the level of responsibility of the company in the accident; the number of deaths; injury to vulnerable persons; and failure to heed warnings or similar circumstances.
