PerkinElmer: an EWC was established

The American advanced technology company signed an agreement establishing a European Works Council on May 28. As Emerson’s – another American company –, which we already commented (see article No. 8472), this new agreement, subject to British law, is quite representative of the way American companies are adjusting to the new obligations introduced by Directive 2009/38 on EWCs.

Transnational nature. The EWC is competent for matters that affect the whole undertaking within the EU or at least two undertakings of the group situated in two different Member States, and matters which, regardless of the number of Member States involved, are of importance for the European employees in terms of the scope of their potential effects, notably in the event of a transfer of activities.
