Austria: Council of Ministers adopts the bill transposing the European temporary work directive

The blockade organized by several employers’ organizations, opposed to some of the provisions of the bill negotiated between the PRO.GE manufacturing union and the Austrian Chamber of Commerce, which supervises employers’ organizations, played a great part in Austria missing the deadline for transposing the European temporary work directive, which should have been done at the end of December 2011 at the latest.  Therefore, the government took over during the year.  On Tuesday, September 4, the Council of Austrian Ministers finally adopted the bill amending the Temporary Workers Act (Arbeitskräfteüberlassungsgesetz – AÜG), which will come into force on January 1, 2013.  The new rules substantially improve the working conditions of the 75,000 agency workers in Austria (end of 2011), following the meaning intended by the directive, which recommends gradually erasing the dividing line between temporary and permanent employees.  Here are the key provisions.
