The National Labour Council adopted, on July 17, 2007, a new collective convention in terms of professional outplacement. These new dispositions on professional outplacement come within the framework of the interprofessional agreement concluded for 2007-2008 and of the Pact for solidarity between generations, which both aim at improving the right to outplacement for people over 45. The new convention – entitled 82 bis – plans that every employer has to offer the worker aged 45 and more a outplacement procedure in the event of a layoff (except for a dismissal for gross misconduct.) As for the dismissed employees, they have to accept this measure and contribute to the procedure. They also have to ask their employer for a social measure if the latter does not make an offer.
