Belgium: the collective labor agreement (CCT) on the obligation to justify layoffs is available

A new chapter in the harmonization of blue-collar and white-collar workers’ statuses, this CCT, No.  109, introduces a new obligation – justifying layoffs – and adds a sanction for breaches to that obligation.  Attached you will find the text of this new agreement, which wasn’t public when we announced that a deal had been reached (article No.  8166).

CCT 109 (February 12, 2014) introduces the obligation for employers to justify layoffs when requested by an employee who has been in the company for more than 6 months (request to be sent at the latest 2 months after the end of the employment relationship). Until now (the CCT will come into force on April 1), when an employer wants to part with a white-collar worker, s/he doesn’t have to explain why, but they do with blue-collars.
