EU : CJEC releases a ruling favorable to private sector recruitment agencies

The Court of Justice of the European Communities (CJEC) has condemned the German legislation which subordinated the remuneration of a recruitment agency to its helping the job seeker find a job only in Germany. (Ref. 070031)

A private recruitment agency, ITC, asked the German public employment service (federal employment agency) the payment of a staff recruitment voucher that the latter had granted to a job applicant. This job seeker had approached the agency to be helped in his job hunt and the agency had found a job for him. It thus asked to be paid for its action. The federal employment agency refused the payment on the ground that the job found by ITC for the person seeking the job was not covered by compulsory
