EU: public consultation on the review of the Statute on the European Company

On September 10, 2009, the European Commission listed 439 SEs in Europe. The Czech Republic had the highest number, 137, followed by Germany, 91, the Netherlands, 22, Great Britain, 16, France, 15, Austria, 13, Luxembourg, 11, Slovakia, 13, Cyprus, 10, Belgium, 10…. Created by the Regulation of 2001, the European Company Statute allows a group of businesses located in different Member States to gather under a same structure answering to European law, notably with the aim of simplifying the legal framework for their cross-border operations. In accordance with this regulation, the European Commission is bound to draw up a report of the new system five years after its enforcement and propose a revision where appropriate. The consultation published last week thus concerns the factors taken into account in the 27 Member States for the creation of a European Company.
