Transnational character. Overriding the Beiersdorf management, which contested the transnational character of the restructuring, the court based its decision on the document communicated to the works council specifying notably: “the group has undertaken to close three plants (closures announced in the Swedish, Dutch and German factories) whose volume of activity will be transferred to other sites of the group in Europe”. Hence the transnational character was clearly demonstrated.
