On 19 April, the content of the long-awaited bill on compulsory time recording was leaked to the German media. Subject matter experts from the Federal Ministry of Labour have prepared a system that will require both employees and companies to electronically record all their hours worked. Exceptions are to be made possible via a collective agreement negotiated between the social partners at company level.
On 13 September 2022 the Erfurt Federal Labour Court (BAG) ruled that all hours worked in Germany should be recorded and since then all stakeholders have been eagerly waiting to learn how this is to come about both legislatively and in practice. The aim is to better ringfence excessive workloads and thus better protect workers’ health.
