The Mobilità procedure was introduced by Law 223 of July 23, 1991 to solve problems related to the lack of legislation on mass layoffs, following European Directive No. 129/1975 reconciling legislation on the matter. Funded by the State and businesses, the Mobilità procedure benefits workers, employees and executives (managers are excluded) of businesses with over 15 employees meeting the criteria for application to the Cassa integrazione guadagni straordinaria (CIGS, see our dispatch No. 080932) and which are to dismiss at least 5 employees within 120 days in the same province: 1/ either after a CIGS period if they cannot reinstate all the suspended workers, or adopt alternative measures; 2/ or directly because of a reduction, transformation or stoppage of the activity.
