Luxembourg: a law to anticipate restructurings

In order for "companies to discuss the anticipated management of their personnel with the social partners well before having to take measures due to economic difficulties", underlines the Minister for Labour, François Biltgen, the law creates a "economic situation committee" which will notably be in charge of obliging the social partners to discuss "a plan to maintain employment". A company employing at least 15 people and which proceeds to a dismissal for non-personal reasons will have to notify the dismissal to the “economic situation committee” which will draw up a monthly statement of the notifications received. It will also centralize the information on the dismissals for cyclical or structural difficulties.
