Luxembourg: implementation of the directive on working time in road transport

The Parliament adopted, on December 6, 2007, a law to implement the Directive n° 2002/15 of 11 March 2002 on the organisation of the working time of persons performing mobile road transport activities (see our article n° 07234). This adoption comes almost two and a half years after the implementation deadline and the European Commission's launching, at the beginning of 2007, of an infridgment procedure against the Grand Duchy. The Directive brings clarifications about working time in the road transport sector in relation to the Regulation n° 561/2006 of 15 March 2006 on the harmonisation of certain social legislation relating to road transport. It notably defines working time, availability time, breaks, resting time or even the night shift. Luxembourg’s law recaptures these provisions while granting social partners certain autonomy, as allowed by the directive, regarding reference periods.
