The new Official Mexican Norm (NOM – Norma Oficial Mexicana) No. 035, entitled ‘Psychosocial risks at work, identification, risks, and prevention”, come into force on 23 October 2019 and requires companies with more than 15 staff to take the ‘emotional well-being’ of their employees into account and to implement ‘prevention strategies’ to combat stress at work (for more on the details of the norm c.f. article No. 11219). In order to better prepare companies for this new regulation the Labor Ministry (STPS) has decided to stagger its application into two stages.
Stage one spanning October 2019 – October 2020 represents an adaptation period for companies so they can get to grips with the new norm. During this time companies are required to:
- Communicate the appropriate information to the employees,
- Undertake preventative actions.
Stage two starts on 23 October 2020 when the new norm officially comes into full effect and it is from this date that companies will be required to:
