In June 2023 Mexico’s Labour Ministry (STPS) published a new regulation on working from home that guarantees the rights of teleworking employees. The text comes into force in December 2023 and will apply to workers undertaking at least 40% of their activities remotely.
On 15 June 2023 and after a year of preparation, regulation NOM 037 on teleworking was published in the Official Gazette of the Federation (DOF). According to the text, the regulation aims to ‘establish occupational health and safety conditions’ for teleworkers ‘in order to prevent accidents and illnesses, as well as to promote a safe and healthy environment.’ In it is a series of obligations for both employers and employees undertaking at least 40% of their work remotely.
