Peru: new telework law introduces digital disconnection time

Peru’s Congress has approved a new telework reform. This new legislation provides for a maximum working time of eight hours to be spread over a total period of twelve hours, as well as the obligation for employers to reimburse some of the electricity and internet costs when employees are working from home. Businesses have sixty days from the publication of the text to implement the new measures.

Voluntary or imposed telework. On 11 September the new legislation was published in the Official Journal and it will come into force at the latest from February 2023. It establishes the principle that the adoption of telework is voluntary for the worker and must be agreed with the employer. However, the text also provides that employer may unilaterally impose teleworking in certain situations, when it is essential for guaranteeing service continuity.
