Demanding from the person who does not have sufficient personal resources to stay in its territory, Belgium imposes a condition which is contrary to the free movement principle. According to the CJEC, an inactive who have necessary resources to live, no matter their origin, has the right of residence. (Ref. 06288)
In order to have a right of residence in Belgium, EU citizens must have sufficient personal income, in order to not become a burden for the country. However, this condition is contrary to Directive 90/364/EEC which confers this right to inactive people, even if according to this Directive Member States may require of nationals of another Member State who wish to reside on their territory that they their family be covered by sickness insurance in respect of all risks in the host Member State and
