Belgium: proposal to open a right of action in favor of posted employees

During the Council of Ministers of January 26th 2007, the Minister for Employment, Peter Vanvelthoven, approved a preliminary draft law which grants posted employees a right to take legal action within the framework of a provision of services. (Ref. 070077)

The project adopted by the government amends the law of transposition of directive 96/71 of December 16th 1996, relating to workers’ posting within the framework of a provision of services. This law of March 5th 2002 notably creates a simplified mode for the social documents kept by companies which post workers in Belgium.
