Czech Republic: pension system declared unconstitutional for failing to guarantee reasonable material comfort for high wages

The case was decided on the basis of a petition of a physically handicapped person, who sued the Czech Republic for the amount of his pension, very low compared to his earnings. In the given case the employee’s earnings base for calculation of the pension according to the reached income before he became handicapped amounted to CZK 68,635 (approx. €2,745) per month; however, the monthly disability pension he received on the basis of Czech law was only CZK 13,346 (approx. €530). Although this case was about the disability pension, please note that the Court’s findings are applicable also with respect to the retirement pension.
